Allegation of police inaction in connection with Jagacha
P.S. No. 380/12 dt. 25.07.12 u/s 376/394 IPC.

The matter relates to reported rape on a woman under Jagacha Police Station in the Howrah Police Commissionerate. It was reported that on 25.07.12 at about 5.00 hours one unidentified middle aged woman on her way to workplace was found to be detected under a bridge near Kona Expressway (Santragachi). She was found to be seeking help from on-going public including one police personnel that she was being assaulted physically and sexually by an unknown youth. Again it was reported that she was first denied any police help when she reached the police station. The matter was reported in all of the leading dailies on 26th July, 2014.

Considering the seriousness of the allegations of police inaction, a report was sought for by the Commission from the Commissioner of Police, Howrah Police Commissionerate within three weeks.

Pursuant to the direction, the police has made a detailed enquiry on the matter. Statement of the victim woman was examined by the local police authorities under Section 161 Cr.P.C. and a police case was started under Section 376/394 of IPC on 25.07.12.

On 26.05.13 the accused Tarak Singh @ Natu of 2, Sultanpur, Bokopara, P.S. Santragachi was arrested by Howrah Police. Later medico-legal test of the accused was also done. On investigation and evidences, a prima-facie case was well-established against the accused Tarak Singh. Accordingly charge-sheet was framed and submitted.

Police officer concerned who refused to render assistance to the victim lady on the day of incidence was detected and penalized in the form of withholding two annual increments by the authorities concerned following departmental proceedings.

As the matter ended in charge-sheet, the Commission does not feel it required to go for further actions.
