The
Government of West Bengal constituted this Commission
vide Notification No. 42 HS/HRC dated 31-01-1995 to
exercise the powers conferred upon and to perform the
functions assigned to the State Commission under Chapter
V of the Protection of Human Rights Act. Section 21(2)
of the Act provides that the State Commission shall, with
effect from such date as the State Government may by notification specify,
consist of -
(a) A Chairperson
who has been a Chief Justice of a High Court;
(b) One Member who is, or has been, a Judge of a High
Court or District Judge in the State with a minimum of
seven years experience as District Judge;
(c) One Member to be appointed from among persons having
knowledge of or practical experience in matters relating to human rights.
The Government of West Bengal vide
its Notification No. 180 HS/HRC dated Calcutta, the
13th March,1995 made the Rules called the West Bengal
Human Rights Commission (Salaries and Allowances and
other terms and conditions of service of the Members)
Rules, 1995, in exercise of the powers conferred by
sub-Section (1) read with Clause (a) of sub-Section
(2) of Section (41) of the Protection of Human Rights
Act, 1993. Rule 3 of the said rules provides that
the Chairperson of the State Commission shall be paid
salary which is equal to the salary of the Chief Justice
of a High Court and other Members shall be paid salary
which is equal to the salary of a Judge of a High
Court.
The West Bengal Human Rights Commission,
in exercise of the power conferred by sub-Section
(2) of Section 10 of the Act framed the West Bengal
Human Rights Commission (Procedure) Regulation to
regulate its proceedings.
